Free speech is never declared more loudly than when it has quietly been hollowed out. Rukeyser’s anaphora - "They say" - mimics the soothing, official voice of a society congratulating itself: no censors, no gulags, no obvious bruises. Then she snaps the frame shut with a final sentence that lands like a verdict: "This is the penalty". The twist is that the punishment isn’t a courtroom sentence. It’s the modern, liberal-democratic kind: dismissal, marginalization, a culture that can tolerate poetry precisely because it has learned to ignore it.

The intent is accusatory but also diagnostic. Rukeyser is pointing to a system where coercion doesn’t need to announce itself. If the public sphere is structured so poems don’t matter - if poets are permitted but rendered harmless - then "no penalty" becomes the penalty: the work circulates without consequence, the writer speaks into a void, and the political imagination shrinks without anyone having to ban a line.

Context matters. Writing in a mid-century America shaped by war, propaganda, anti-Communist suspicion, and tightening norms around dissent, Rukeyser understood that repression can be social and economic as much as legal. The subtext is practical: you can publish and still be punished through blacklisting, professional isolation, or the soft violence of being deemed "irrelevant". Her rhetoric works because it refuses melodrama. It doesn’t argue that freedom is absent; it argues that freedom can be managed - granted on the condition that it changes nothing.
