Holmes’s line is a velvet-gloved punch at moral absolutists who treat earthly life as a mere audition for purity. Calling himself “on the side of the unregenerate” is a deliberate self-styling: he adopts the language of damnation to defend the supposedly damned. It’s a jurist’s provocation, but also a veteran’s hard-earned impatience with pieties that romanticize suffering. Holmes fought in the Civil War; he knew how easily high-minded ideals can get people killed. The sentence carries that scar tissue.

The opposition is clean and theatrical: “worth of life as an end in itself” versus “saints who deny it.” “Saints” aren’t just religious figures here; they’re any zealots of principle who exalt sacrifice, chastity, asceticism, or “higher” purposes over the messy, contingent business of living. Holmes’s target is the impulse to smuggle a comprehensive moral theology into public authority. Coming from a judge, the subtext is institutional: law shouldn’t act like a monastery. It should manage conflict among fallible people, not sort souls into saved and unsaved.

What makes the quote work is its inversion of moral prestige. The “unregenerate” usually occupy the rhetorical basement; Holmes moves them to the moral high ground by redefining seriousness as affirmation, not denial. He isn’t arguing for hedonism so much as for a civic ethic of humility: once you admit life is valuable in itself, you become suspicious of anyone claiming a mandate to override it in the name of sanctity. That suspicion is the seed of modern liberal jurisprudence - and its permanent friction with moral crusades.
