"One thing, however, is sure, - that in all cases the effort should be to impose all the cost of repairing the wrong upon the doer of the wrong. This alone is real justice, and of course such justice is necessarily free"
About this Quote
The subtext is a quiet attack on the state’s favorite bait-and-switch. Governments talk in the language of justice while delivering something else: cages, fines that disappear into public coffers, court fees that punish the poor, and a whole industry of professionals paid to manage harm without necessarily repairing it. Tucker’s radical move is to treat justice as restitution, not retribution, and to frame the “free” part as a proof: if the wrongdoer actually makes the victim whole, justice doesn’t require a sprawling, expensive apparatus. It doesn’t need to be sold back to people as a service.
Context matters. Tucker was a leading figure in American individualist anarchism, suspicious of monopolies and state power alike. His ethic here is anti-paternalistic and anti-carceral: less “the state must punish,” more “harm must be corrected.” It’s also a dare. If you’re serious about justice, stop outsourcing the costs to everyone except the person who caused the damage.
