He insists on a simple calculus: a wrong creates a cost, and the only defensible outcome is to load that cost onto the wrongdoer. Not society. Not the victim twice-over. Not taxpayers underwriting the aftermath while the system congratulates itself for being “tough.”

The subtext is a quiet attack on the state’s favorite bait-and-switch. Context matters. Tucker was a leading figure in American individualist anarchism, suspicious of monopolies and state power alike. His ethic here is anti-paternalistic and anti-carceral: less “the state must punish,” more “harm must be corrected.” It’s also a dare. If you’re serious about justice, stop outsourcing the costs to everyone except the person who caused the damage.
