Without decisional authority, “equality” becomes a costume draped over dependency.

The subtext is a rebuke to a certain American compromise: celebrate women’s progress while quietly preserving structures that presume women’s choices are negotiable. Ginsburg’s phrasing also exposes how rights debates are often miscast as matters of sentiment or “values.” She frames them as power arrangements. Who decides? Whose preference is “controlling”? That last word is doing real work: it smuggles the vocabulary of governance into the supposedly private sphere, insisting that what happens to a body, a career, a family, is inseparable from citizenship.

Context matters. Ginsburg rose through an era when formal barriers were falling but social and legal habits lagged. Her equality jurisprudence repeatedly linked gender equality to autonomy, especially in reproduction and family roles, where the state and tradition had long acted like co-parents. The line is compact because the argument is surgical: if your life can be directed by someone else’s vote, your status is, by definition, second-class.
